Equipment hire terms and conditions for Buffalo Plant Hire Ltd

These terms and conditions apply to all equipment hire agreements with Buffalo Plant Hire Ltd.
By hiring equipment from us, you agree to be bound by these terms.
In these terms:
2.1 Equipment is hired in good working condition and the Hirer accepts responsibility upon delivery.
2.2 Any defects must be reported immediately upon delivery.
2.3 The Hirer should inspect equipment before use and report any concerns immediately.
2.4 Equipment must be returned in the same condition as delivered, subject to fair wear and tear.
3.1 Hire charges commence from the time equipment leaves our depot.
3.2 Payment terms are typically 30 days from invoice date unless otherwise agreed.
3.3 Late payment charges may apply at 1.5% per month on overdue amounts.
3.4 Security deposits may be required for certain equipment or new customers.
4.1 The Hirer must ensure operators are competent and appropriately certified.
4.2 Equipment must be used only for its intended purpose and within safe working limits.
4.3 Daily safety checks and basic maintenance are the Hirer's responsibility.
4.4 The Hirer must provide adequate site security and protection from theft.
4.5 Any damage, theft, or breakdown must be reported immediately.
5.1 All equipment is hired out WITHOUT INSURANCE. The Hirer is solely responsible for obtaining adequate insurance coverage.
5.2 The Hirer must maintain adequate public liability insurance (minimum £2 million) and provide proof of cover upon request.
5.3 The Hirer is fully liable for any loss, theft, damage, or destruction of equipment during the hire period, regardless of cause.
5.4 The Hirer must notify Buffalo Plant Hire Ltd immediately of any damage, breakdown, theft, or incident involving the equipment.
6.1 Delivery and collection times are estimates and may vary due to operational requirements.
6.2 The Hirer must ensure suitable access for delivery and collection vehicles.
6.3 Delivery charges apply according to distance and current rate schedule.
6.4 Failed collections due to site access issues may incur additional charges.
7.1 Mechanical breakdowns due to normal wear are covered by Buffalo Plant Hire Ltd.
7.2 Damage due to misuse, negligence, or operator error is the Hirer's responsibility.
7.3 Replacement equipment will be provided for covered breakdowns where possible.
7.4 24/7 breakdown support is available for emergency situations.
8.1 Either party may terminate the hire agreement with reasonable notice.
8.2 Buffalo Plant Hire Ltd may recover equipment immediately for breach of terms.
8.3 All charges remain payable up to the date of actual return.
8.4 Early termination does not affect accrued payment obligations.
9.1 The Hirer must comply with all relevant health and safety legislation.
9.2 Risk assessments and method statements are the Hirer's responsibility.
9.3 All operators must be properly trained and certified for the equipment.
9.4 Safety documentation is provided with each equipment delivery.
10.1 Buffalo Plant Hire Ltd's liability is limited to the replacement cost of equipment.
10.2 We exclude liability for consequential losses, delays, or business interruption.
10.3 Our maximum liability shall not exceed the total hire charges for the equipment.
10.4 These limitations do not affect statutory rights.
11.1 Neither party is liable for delays due to circumstances beyond reasonable control.
11.2 This includes weather, strikes, government actions, or other unforeseen events.
11.3 Alternative arrangements will be made where practically possible.
12.1 These terms constitute the entire agreement between the parties.
12.2 Any variations must be agreed in writing.
12.3 These terms are governed by English law.
12.4 Disputes will be subject to the jurisdiction of English courts.
